The aim of the doctrine of strict compliance with respect to bank guarantees in international trade is to ensure legal certainty. The bank or guarantor has a very important task in observing the application of this rule. This project seeks to find the answers to the question what the ambit is of the bank’s duty of care in this regard. What should be the obligations of a bank or guarantor under a bank guarantee in order to ensure legal certainty?
