Abstract:
My research focuses on the transfer of movables in Belgian law and more specifically on the question whether there exists a delivery requirement in the Belgian transfer system, and what the implications of such delivery requirement are (cf. third party protection, false appearance of solvency, transfer of risk, etc.). As part of this research we will take a closer look at the French transfer system, as well as the German transfer system, the Dutch transfer system and the English transfer system, and at the general principles of the DCFR.
