Abstract:
Determining a correct amount of compensation for pain and suffering, anxiety, loss of enjoyment of life or loss of life itself is difficult. The latter is often excluded from compensation, whereas damages for the other types of losses differ greatly between and within countries. In the fields of Law and Economics and Health Economics, several approaches exist which might provide a more thorough underpinning of the legal treatment of these losses: Value of a Statistical Life, Value of a Statistical Life Year and Quality Adjusted Life Year. The proposed research investigates the possible utilizations of these approaches in the law of damages.
