Case management in English, French and Dutch Civil Litigation Compared

Abstract:

The research project aims to analyse the courts case management powers in civil litigation in England, France and The Netherlands from a comparative and historical perspective. The civil procedure rules, their implementation and court-related practices will be analysed and compared. The balance that the various systems of civil procedure strive to find between the societal interest of an efficient court procedure and the legitimate interests of litigants to dispose of their private rights and obligations will be evaluated
