Punitive elements in contract law and the law of obligations

Abstract:

How can legal systems deter breach of contract and should breach of contract be deterred? During this research the existing punitive elements in contract law and the law of obligations will be explored and evaluated on their efficiency and opportunity. A comparison with the concept of punitive damages for breach of contract in the US will be done, as well as research into evolutions regarding punitive damages in the Netherlands, France and on a European level.
