Abstract:
The European Court of Human Rights has increasingly formulated obligations upon member states to actively secure human rights. These positive obligations affect the national liability law. This research focuses on this influence and investigates what consequences it has for Dutch civil and criminal liability law and how it will develop in the future. A comparative legal study is part of it.
