Abstract:
Currently, Patent protection plays a crucial role in the biotechnology R&D. Perhaps there is no industry more dependent on the value of patent than biotech. With respect to biotechnological patent protection, the most important thing is to confirm the patentable subject matter. This research aims to find out the similarities and differences of patentable subject matter regarding biotechnology among the EPO, the U.S. and China and reveal general underlying rationales. If possible, this essay would propose an equitable model law regarding patentable subject matter in biotechnology to build a balance patent protection system to promote biotechnological research and industry.
