Abstract:
The new European Supervisory Authorities confirm the otherwise still very embryonic development of European regulatory agencies. Because of the - soft - regulatory powers that have been assigned to them, concerns of both legitimacy and effectiveness present themselves. By making a detailed case study of one of these agencies the European Securities and Markets Authority (ESMA) - it is possible to analyse what changes in terms of institutional and good governance guarantees would be required with a view to ensuring compliance of regulatory procedures of European agencies, like those of ESMA, with both the principles of legitimacy and effectiveness.
