Abstract:
Strict liability is a hot issue in tort law. Both French and Chinese experiences are unique. This proposal takes traffic accident compensation system as an example, also focuses on whether the development of the law of torts is at improving of the position of victims, relieves heavy burden on injurers and avoids unnecessary lawsuits, and the study will involve law and economic analysis. Thus, we could find possible solutions to the current problems the tort law of China faces and probably also gain valuable insights for the unification of the European tort law particularly concerning strict liability.
