Abstract:
I study the way in which different legal systems arrive at particular rules in the law of contracts. In particular, I am interested in the reason why common law countries favour compensatory remedies while civilian ones prioritise specific performance, in differences between national remoteness rules, and in the different treatment of liquidated damages in England and continental Europe. More broadly, my research concerns economic models of legal change under precedent and statute, legal history, and jurisprudential theory.
