Abstract:
This research concerns the systematization of famous trademark regulation mechanism of China.
The term 'famous trademark' was created in 1990s by Chinese local governments and it spread fast domestically. By now, regional famous trademark regulation mechanisms have been established in most Chinese provinces. They offer extra favourable conditions to local enterprises but do not unified with each other. Their support and protection is increasingly enhancing but not have any Chinese national level law basis. Thus, legal status, cognizance standard and protection mode remain in chaos.
This research suggests that, the disorder and confusion of famous trademark regulation mechanisms shall be solved. Either appropriate legal status shall be sought or added in national law level, or the regulation mechanisms themselves shall exist in a more harmonized way. The author will figure out which way fits better with Chinese’s situation by conducting comparative researches with selected jurisdictions.
