Abstract:
This research examines the international legal regime (or lack thereof) governing territories that form part of one state de jure, but are either independent or governed by another state de facto. This question is not limited to state like territories (such as Somaliland or Taiwan); rather the questions raised also apply in respect of territories effectively governed by non-state armed groups, an increasingly prevalent political circumstance. This research will culminate in the proposal of an international law framework to be applied in respect of these territories in order to hold their governing bodies accountable for internationally wrongful acts.
