Abstract:
Increased attention is paid by legal scholars to a conception of tort law as a regulatory mechanism for health and environmental risks. This PhD research analyses this phenomenon from a doctrinal and theoretical perspective. It explores what place tort law could occupy in the regulatory ecosystem. In other words: what role can tort law fulfil as a regulatory instrument?
