Abstract:

The focus of the PhD research project lies on examining the intersection of international commercial arbitration and corporate social responsibility. By recognizing the significant impact that commercial activities can have in society as a starting point, the PhD project sets out to investigate the role that international commercial arbitral tribunals can play in promoting corporate social responsibility and in condemning socially irresponsible behaviour by commercial actors. The PhD project will make use of doctrinal and empirical legal research methods to examine the different ways in which international commercial arbitral tribunals can recognize norms on corporate social responsibility as legally relevant standards and, accordingly, apply them for the resolution of commercial disputes during the arbitral proceedings.
