Abstract:
Jan van Staalduinen is working on a doctoral thesis on liability for (artificial intelligence/AI) algorithms, with a particular focus on algorithms in the medical sector. In doing so, he focuses on three relevant legal relationships: the contractual relationship between patient and doctor/hospital, the contractual relationship between hospital and the manufacturer of the AI system and the non-contractual relationship between patient and producer. The ultimate aim is to find out, from a dogmatic perspective and taking into account developments in EU law, how the relevant liability standards - terms such as 'reasonable professional', 'unfitness' and 'defect' - can be applied to this new technology and how possible residual risk is distributed.
