Abstract:
Where the CJEU and ECtHR have recently emphasized that rainbow families are deserving of legal protection, the EU legislator remains mostly silent. Nevertheless, the European Commission and European Parliament have both highlighted the need to take action. This research aims to investigate how the EU legislation currently protects rainbow families in comparison to heteronormative families; what legislative action would be necessary and feasible for EU law to meet the human rights standards set by both the CJEU and the ECtHR regarding the protection of rainbow families; and how such action interacts with the constitutional design of the EU.
